Terms of service
In short
- These terms apply when you use our websites, apps and services or buy from us.
- Prices are in Botswana pula. We are not registered for VAT, so no VAT is added.
- Subscriptions renew monthly or yearly until you cancel. You can cancel at any time.
- Card payments are handled by our payment provider. We never see or store your full card number.
- Botswana law applies.
1. Who we are
These terms are an agreement between you and Vikaranet (Pty) Ltd ("Vikaranet", "we", "us"), a company registered in Botswana under number BW00010041782, at Plot 360, Independence Avenue, Extension 4, Gaborone. You can reach us at [email protected] or +267 7300 6292.
2. What these terms cover
They cover vikaranet.com, our web apps (including ThebeLedger, DPA Manager, Bots Income Tax Calculator and Tsala AI), our mobile apps, and our professional services such as onboarding, training and DPA readiness health checks. Where you sign a quote, order form or service agreement with us, that document applies alongside these terms and wins if the two disagree.
If you use our services for a business, you confirm you have authority to accept these terms for it.
3. Accounts
- Give us accurate details and keep them up to date.
- Keep your password safe. You are responsible for activity on your account, including by people you invite.
- Tell us straight away at [email protected] if you think your account has been misused.
4. Prices and quotes
- Prices are in Botswana pula (BWP) unless a quote says otherwise. Vikaranet is not registered for VAT, so our prices and invoices carry no VAT. If we register, we will add VAT at the legal rate from the date of registration and tell you first.
- Quotes are valid for the period shown on them, usually 30 days.
- We may change subscription prices with at least 30 days' notice. The new price applies from your next billing period after the notice ends. If you don't agree, you can cancel before then.
5. Payment
- You can pay by bank transfer (EFT) or by card. Some services also accept mobile money.
- Card and mobile money payments are processed by our payment provider, which is responsible for keeping your card details secure. We never receive or store your full card number.
- Invoices are payable within the time shown on them. We may suspend a service if payment is more than 14 days overdue, after giving you notice.
- Purchases made inside an app downloaded from Google Play are billed by Google under its own terms.
6. Subscriptions, trials and cancellation
- Subscriptions run monthly or yearly and renew automatically at the end of each period until cancelled.
- Where we offer a free trial, we will tell you before it ends. You will only be charged if you continue after the trial.
- You can cancel at any time from your account or by emailing [email protected]. Cancellation takes effect at the end of the period you have paid for, and you keep access until then.
- Our refund policy explains when money is returned.
7. Using our services fairly
You agree not to:
- break any law, or use our services to harm, defraud or spy on anyone;
- try to access systems or data you are not authorised to, or test our security without our written permission;
- upload malware, or overload, copy or resell our services without our agreement;
- use DPA Manager, or any security feature, against networks you don't own or have permission to monitor.
We may suspend or close an account that breaks these rules, and will explain why unless the law prevents us.
8. Your data
Your business records, logs and files remain yours. We use them only to provide the service to you, as set out in our privacy policy. DPA Manager runs on your own servers, so its data stays with you. We only access it if you ask us to under a managed service agreement. Where we process personal data on your behalf, we act as your processor and follow your written instructions.
You can export your data while your subscription is active and for 30 days after it ends. After that we may delete it.
9. Our intellectual property
Our software, designs, brands and content belong to Vikaranet or our licensors. We give you a personal, non-transferable right to use them while your subscription or licence is active. Open-source components, such as Spend Meter, are covered by their own licences.
10. Availability and changes
We work to keep our services available and secure, but we can't promise they will be uninterrupted or error-free. We may improve or change features. If a change significantly reduces a service you pay for, we will tell you, and you can cancel and receive a pro-rata refund of any prepaid amount for the remaining period.
11. Professional advice
Bots Income Tax Calculator, ThebeLedger and DPA readiness health checks help you work things out. They are not legal, tax or accounting advice. Check important decisions with a qualified adviser.
12. Liability
Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under Botswana's Consumer Protection Act. Otherwise:
- we are not liable for indirect or consequential loss, or for loss of profit, revenue or data that you could have prevented, for example by keeping backups;
- our total liability under these terms in any 12 months is limited to the fees you paid us in that period.
13. Ending the agreement
You can stop using our services at any time. We may end these terms with 30 days' notice, or immediately if you seriously breach them. Sections 8, 9, 12 and 15 continue to apply afterwards.
14. Changes to these terms
We may update these terms. We will post the new version here with its effective date, and give at least 30 days' notice of important changes to paying customers.
15. Law and disputes
These terms are governed by the laws of Botswana. If you have a complaint, please contact us first so we can try to resolve it. If we can't, the courts of Botswana will decide the dispute.
